The agreement between you and us when you use or buy Alpha-DJ-Engine.

1. Who you are dealing with

Alpha-DJ-Engine is made and sold by Alphabees UG (haftungsbeschränkt), Kolonnenstraße 8, 10827 Berlin, Germany. Full details are in the imprint.

These terms apply to the free version and to the paid licence. They apply to consumers and to business customers alike; where a clause applies only to one of them, it says so.

2. How the contract comes about

You can download and use the free version without paying. A paid contract is formed inside the app: you choose to buy the licence, you are shown the price and these terms, and the contract takes effect when your payment is confirmed.

We then send you a confirmation by email, together with the information the law requires us to give you on a durable medium.

3. The free version

The free version is the complete application, limited to analyzing and exporting ten tracks in total. It is not time-limited and we do not ask for payment details to use it. We may change what the free version includes for future users, but not retroactively for a licence you have already bought.

4. What your licence covers

When you buy, you get a non-exclusive, perpetual right to use Alpha for your own purposes — private or professional — on one device at a time, for one person. There is no renewal and no expiry date.

The licence is personal to you and cannot be sold, lent or passed on to someone else. If you replace a machine, you can move the licence yourself in your account.

5. What you may not do

Please do not share your licence with other people, work around the limits of the free version, or take the software apart in order to rebuild or resell it. You may of course decompile it to the extent the law expressly permits — § 69e UrhG on interoperability is untouched by these terms.

The software itself, its source code and its design remain ours.

6. Price and payment

The licence costs €30 including VAT. Payment is handled by Stripe; the payment methods available are shown at checkout. The licence is activated once the payment has gone through.

7. Right of withdrawal

If you are a consumer, you have a statutory right to withdraw within 14 days. The full notice, including the model form and how the right can lapse early for digital content, is on the withdrawal page.

8. Updates, and what happens to the cloud part

Updates are included in the price. We provide them for as long as you can reasonably expect them for a product of this kind, as required by German law on digital products (§ 327f BGB).

Part of Alpha runs on our servers: arranging your set harmonically is done there. Analysis and writing to the USB drive happen entirely on your own machine.

If we ever switch that service off, your licence does not die with it. Before we shut down the sequencing service, we will release a full desktop version to everyone holding a lifetime licence — one that does the arranging on your own machine and needs no connection to us at all. We commit to this as part of your contract, not as a favour.

9. If something does not work

Alpha has to be what we described and has to keep working. If it does not, you can ask us to fix it; if we cannot fix it within a reasonable time, you can reduce the price or end the contract and get your money back. These are your statutory rights under §§ 327 ff. BGB and we do not limit them.

What we cannot promise is that every track in every library analyzes perfectly, or that a set we arrange is the one you would have arranged. Alpha proposes an order; the gig is still yours.

10. Liability

We are fully liable for damage caused intentionally or by gross negligence, for injury to life, body or health, under the Product Liability Act, and where we have given a guarantee.

For slight negligence we are liable only where we breach an obligation that is essential to this contract and that you may rely on us to meet, and then only for the damage typically foreseeable in a contract of this kind. Any further liability is excluded.

Please keep your own backups of your music and of your USB drives. Alpha creates a backup of the Engine database before it writes, but that is not a substitute for your own.

11. Changes to these terms

We will tell you in good time if we need to change these terms, and explain why. For a licence you have already bought, changes only take effect if you agree to them. Your silence is not agreement.

12. Governing law and courts

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the EU, this choice does not deprive you of the protection of the mandatory rules of your own country.

Courts: wherever the law puts them. For consumers that is normally the place where you live.

These terms are written for private customers. If you happen to buy in the course of a business, the consumer-only provisions above — the right of withdrawal in particular — do not apply to you, and the place of jurisdiction is Berlin.

The European Commission's online dispute resolution platform is at ec.europa.eu/odr. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

13. Language

These terms and the contract are in English. If we provide a translation, the English version prevails, except where the mandatory law of your country of residence says otherwise.
